Provisional Exemptions for Unlawful Presence

Immigrants who have been in the United States illegally for more than six months face a three-year reentry ban, and those who have been in the United States for more than one year face a ten-year ban. However, the Provisional Waiver program allows applicants to manage this process while still in the United States, before their visa interview in their home country. This helps minimize family separation time.

Eligibility Requirements for the Provisional Unlawful Presence Waiver

Only immigrants with unlawful presence in the United States are eligible to participate in this program. Applicants must demonstrate that their absence would cause extreme hardship to a U.S. citizen or legal permanent resident family member. It is crucial that the affected person be the applicant's spouse or parent, as parents of U.S. citizens are not eligible to apply for this type of Provisional Waiver.
