Eligibility Requirements for the Provisional Unlawful Presence Waiver
Only immigrants with unlawful presence in the United States are eligible to participate in this program. Applicants must demonstrate that their absence would cause extreme hardship to a U.S. citizen or legal permanent resident family member. It is crucial that the affected person be the applicant's spouse or parent, as parents of U.S. citizens are not eligible to apply for this type of Provisional Waiver.
Additionally, applicants whose notice to appear has been canceled by ICE may also apply for a provisional waiver. To qualify, they must meet the following requirements:
Be physically present in the United States at the time of submitting the waiver application.
Be at least 17 years old.
Have an approved petition for an immediate relative (Form I-130 or I-360).
Have a specific family relationship with a United States citizen or legal permanent resident.
Be inadmissible solely on the basis of unlawful presence in the United States.
Be able to demonstrate that your absence would cause extreme hardship to an eligible family member.
